Abstract | Law is subject to constant changes and, in particular, to changes in its context and in the societies it is meant to serve (ubi societas, ibi ius). Similarly, comparative law is used in many senses and different contexts. Moreover, the meaning attached to it is often subject to contestation and varies widely in accordance with the respective epoch in time and location in space. In the present context, it is time to assess again the current state of comparative law by proposing the hypothesis that comparative law has entered a new phase and may be needed to perform a new role in the framework of law as a legal science. Based on drastic changes brought about by the relentless process of globalization, this brief paper, representing ongoing research, aims at assessing whether a new role for comparative law may consist in a shift from the main interest in comparing foreign and domestic law to comparing different methods of cognition against the backdrop of the urgent need for the establishment of a true debate about future global governance. |
