With the formal separation occurred in the 19^th century between Substantive Law and Procedural Law, Substantive Right and Right of Action, grosso modo, came to a parting of the ways. Nevertheless, that's not always been the case before. This paper aims to show the historical context of the “integration-separation” path of these two concepts in detail, trying to trace out the pedigree of such a fundamental subject, and provide a foundation for further doctrinal discussions.
