Abstract

随着19世纪实体法、程序法正式分道扬镳,实体权利与诉权各自进入了大体独立的轨道。然而,在此之前两者的关系并非如此。详细地展示其合、分进程的历史脉络,尝试描摹出此一基础课题的谱系,可以为学说的进一步讨论提供基础。 

Other Abstract

With the formal separation occurred in the 19th century between Substantive Law and Procedural Law, Substantive Right and Right of Action, grosso modo, came to a parting of the ways. Nevertheless, that's not always been the case before. This paper aims to show the historical context of the “integration-separation” path of these two concepts in detail, trying to trace out the pedigree of such a fundamental subject, and provide a foundation for further doctrinal discussions.
