Abstract | Administrative punishment is the term that is used to describe penalties that may be imposed in the administration of public security in China. Crime is defined as behavior that reaches a certain level of severity. Much minor antisocial behavior is not defined as a crime and thus is not dealt with under the Criminal Law of the People's Republic of China. Instead, such behavior is dealt with by the public security organs, primarily the police, under the 2005 Law on Administrative Penalties for Public Security Offenses. The penalties stipulated in the law are essentially administrative, as the public security organs are the only entities that can enforce the law and carry out the punishments. Normally no court trials or further criminal proceedings are required when dealing with this type of minor antisocial behavior. |
