Abstract

The information revolution led by the emergence of big data and algorithms has brought many fundamental changes to the world's economic, political, and technological structures, which exacerbated vulnerability of the weaker parties in transactions. This chapter attempts to study the protection of the weak party in consumer transactions. Avoid taking a one-sided view on high-tech effects, the autonomy of will of consumers deserves more protection and the social welfare shall be considered. A simplistic view that the new emerging technologies are unethical is unhelpful. The laws in Hong Kong and Macau are derived from legal transplants and localization under the colonial contexts, which makes them distinct. Due to the special status of the bay area, in the future, soft law and algorithm-based regulation will likely be adopted to confront the challenges caused by the information revolution.
