Contextualization: The xenophobic attacks in South Africa in May 2008 raised concerns with the protection of migrants in host countries in Africa, considering the large condemnation of those acts from African governments. As a matter of fact, the attacks are seen not only as grounded on the fact that those who were attacked be foreigners but also because they represent minorities in South Africa. Considering that some of those xenophobic acts victims are from southern Africa countries, who together with South Africa belong to the Southern Africa Development Community (SADC), a regional integration organization, it is important to see how the regional legal and political instruments deal with the minorities’ rights.

Objective: This study is aimed at assessing to which extent the SADC legal instruments offer an adequate answer to the minorities’ concerns, particularly of the migrants within the Community region, and how they can contribute to the protection of the minorities’ rights against the tensions brought by the majorities’ rules.

Method: This essay consisted of a hermeneutic method that, through the interpretation of legal instruments, seeks to identify the answers to the raised questions.

Results: As a result, in a context of regional integration, the protection of minorities resulting from the interaction between the people of the region must be enshrined in regional instruments, a situation that does not occur in SADC, since, in general, migrants are in a situation of fragility regarding the protection of their rights, as there are no regional legal instruments and mechanisms capable of implementing them.

Contextualização: Os ataques xenófobos na África do Sul, em maio de 2008, despertaram as preocupações com a proteção dos migrantes nos países hospedeiros em quase todo o continente africano, a avaliar pela ampla condenação dos mesmos atos pelos governos africanos. Com efeito, os ataques são vistos não só como fundados no facto de aqueles que foram atacados serem estrangeiros, mas também porque representam minorias na África do Sul. Considerando que alguns dos grupos vítimas daquelas ações xenófobas são oriundos de países que, juntamente com a África do Sul, integram a Comunidade de Desenvolvimento da África Austral (SADC), é importante ver como os instrumentos jurídicos e políticas regionais lidam com os direitos das minorias.

Objetivo: O ensaio tem como objetivo aferir em que medida dos instrumentos jurídicos da SADC fornecem uma resposta adequada às preocupações das minorias no espaço comunitário e como eles podem contribuir para a proteção dos direitos das minorias contra as tensões trazidas pelas regras das maiorias.

Método: O presente estudo assentou num método hermenêutico que através da interpretação dos instrumentos legais procurou obter as respostas aos problemas suscitados.

Resultados: Apurou-se que num contexto de integração regional a proteção das minorias resultantes da interação entre as pessoas da região deve ter nos instrumentos regionais a sua consagração, situação que não se verifica na SADC, na medida em que, no geral, os migrantes encontram-se numa situação de fragilidade quanto à proteção dos seus direitos, visto não existirem instrumentos e mecanismos regionais capazes de concretizá-los.
