| Abstract | 直接、言詞原原是大陸法系國家適用的原則,傳聞證據規則是英美證據法的重要規則。大陸法系的直接、言詞原則與英美法系的傳聞證據規則常常被作為相互對應的概念而相提并論。然而,直接、言詞原則與傳聞證據規則雖有許多相似之處,卻又有一些差異。此文嘗試以比較法學的方法對直接、言詞原則與傳聞證據規則進行分析探究,并在此基礎上提出了我國借鑒相關規則的基本思路與方法。 |
