| Abstract | 兩願離婚及訴訟離婚是澳門離婚法律制度的兩種離婚的程序，但無論哪一種程序，盡量調解雙 方當事人都是澳門立法者的立法目的，其中最特別的情況是訴訟離婚中調解當事人而轉為兩願離 婚程序的情況。本文對訴訟離婚的試行調解制度進行系統性分析，且結合訴訟離婚與兩願離婚程 序上相互轉化的特質以進行比較，使讀者可以從理論到司法實踐上對訴訟離婚的試行調解制度在 設置上的靈活性優勢有充分的了解。 |
