Consensual settlement of competition disputes in China: a call for conditional arbitrability

Abstract

The current reform of Chinas Arbitration Law is aimed at makingthe country a more attractive seat for international commercialarbitration and at encouraging consensual dispute settlement tosupplement the heavy workload of the courts. At the same time,due to the lack of certainty as to the arbitrability of antitrustdisputes, the competition-related arguments may effectively stallor delay arbitration proceedings or create the risks of settingaside of arbitral awards on public policy grounds. The paperaddresses the aforementioned problem by advancing a call forconditional arbitrability of antitrust disputes in China, which willrequire clarification of the applicable legal standards and detailedprocedural guidance by the Supreme Peoples Court that wouldinstruct the arbitrators and the parties about applyingcompetition rules in the context of contractual disputes. Thispolicy proposal is grounded on the analysis of the divergentjudicial approaches to arbitrability of competition-related issuesdeveloped by the Chinese judiciary.
