Abstract	多數不是集體，多數服從集體在闡釋831的「過半數」規定時，李飛主任反復強調那是為了「體現集體意志」。可見集體意志是立法目標。當有多種過半數方法時，應選最體現集體意志的一種。除非全體一致，集體包含多數與少數，少數服從多數不是集體意志，兼顧多數與少數才是集體意志。當然，最理想是遵循「全體意志」，譬如三職位選舉中全體公認某三人應當選。但人間常有分歧，若不存在全體意志，最接近全體的意志就是集體意志。 ......
