在人工智能技術不斷拓展應用範圍的時代背景下，中醫館作為基層中醫綜合性機構的代表，依託多種健康信息平台項目，致力於推進中醫藥信息化和智能化服務。

然而，該進程亦引發了與人工智能應用相關的法律爭議，這些爭議涉及角色不明、信任危機以及保健與隱私取捨等情景。為規避中醫館人工智能應用之爭議風險，彌補適法困境，本報告採取多方參與、倫理評估、法律規範等總體爭議處理思維方法，綜合考慮中國人工智能應用和醫療管理規範的實際情況，並批判性汲取美國和歐盟在醫療人工智能立法方面的經驗。

針對人工智能應用問題，建議完善中國中醫館人工智能應用的風險評估機制和持續檢視機制；明確監管框架和政策規定，確立中醫館人工智能應用中的侵權責任劃分；構建符合中醫藥價值體系的倫理規範，以確保中醫館人工智能的安全和有效性，保護患者的權益，最終推動人工智能在中醫醫療領域的發展，實現其潛在的應用價值。

In the era of expanding applications of artificial intelligence technology, as a representative of grassroots comprehensive traditional Chinese medicine institutions, the Chinese Medicine Clinic is committed to promoting the informatization and intelligent services of traditional Chinese medicine through various health information platform projects.

However, this process has also triggered legal disputes related to the application of artificial intelligence. These disputes involve issues such as unclear roles, trust crisis, and the trade-off between healthcare and privacy. In order to mitigate the controversy risks associated with the application of artificial intelligence in Chinese Medicine Clinics and address the legal challenges, this report adopts a comprehensive approach to handling disputes, including multi-stakeholder participation, ethical assessment, and legal regulations. It takes into account the practical situation of artificial intelligence applications and medical management regulations in China, as well as critically draws on the experiences of the United States and the European Union in legislation regarding medical artificial intelligence.

Regarding the issues of artificial intelligence application, it is recommended to improve the risk assessment mechanism and continuous review mechanism for the application of artificial intelligence in Chinese Medicine Clinics. Clear regulatory frameworks and policy provisions should be established to define the division of infringement liability in the application of artificial intelligence in Chinese Medicine Clinics. Ethical norms that align with the value system of traditional Chinese medicine should be constructed to ensure the safety and effectiveness of artificial intelligence in Chinese Medicine Clinics, protect the rights of patients, and ultimately promote the development of artificial intelligence in the field of traditional Chinese medicine, realizing its potential application value.
