The purpose of this text is the study of the effects of the renewal of a trademark in the period of non-use as cause for revocation of the trademark. We will address what is the non-use as cause of revocation of the trademark, what are the reasons that explains its provision in most legal systems, when non-use is justified and how the trademark owner can prevent the revocation. Next, we will address the renewal of the trademark, what are its advantages and its fundaments. We will compare then the cause of revocation for non-use with the cause of revocation for non-renewal, concluding that the renewal bears no influence in the expiry period of non-use for revocation purposes. We will confirm this conclusion looking into the problematic of refiling of trademarks.
