Abstract | Legal semiotics is broadly concerned with how, in law, meaning is derived from the communication of information through language and other signs and symbols. Synaesthesia describes a condition in which one sensory modality also gives rise to a sensation in a different modality, like seeing colours when listening to music or experiencing time as a spatial form. The variety with which this condition is experienced provides – both in facts and in words – a powerful critique of the traditional separation of the individual senses, which also has serious implications for the law and how it shapes the world. Captured by the term “legal synaesthesia”, this chapter advocates a multisensory approach in law, and argues that this provides a better conceptual and cognitive framework for law in both theory and practice. The advantages of a synaesthetic approach in law will be exemplified by a few selected examples of current regulatory challenges posed by the special dynamics of the creative economy, the regulation of the use of subliminal techniques by artificial intelligence systems, the process of adjudication, and, generally, its use as a de-fragmentation technique in (international) law. |
