Abstract

The article analyses the intersection between international investment rights and the international human right to water. Specifically, it focuses on four disputes at the International Centre for Settlement of Investment Disputes (ICSID) that concerned water privatization contracts between foreign investors and developing countries. Although attention to these disputes tends to be offered through an antiprivatization lens, inevitably pitting the human right to water against foreign investors' rights, the recent ICSID arbitral decisions, ironically rather contribute towards a harmonious relationship between the human right to water and investment obligations. They thus turn an otherwise legally uncertain human right to water into a justiciable, enforceable right, and ultimately they offer a promising method for helping address the looming global water crisis.
