Abstract

International Water Law has been witnessing a progressive economization of water, encompassing the integration of an economic logic in the regulation of water services. This move comprehends a tendency to protect foreign investments in this sector. In parallel, we are witnessing the decisive international recognition of a human right to water. These two trends of modernization of the international regulatory treatment of water might appear to lead to a necessary collision of rights and broader regulatory developments. However, more recently, the potential for litigation associated with these lines of evolution gave rise to actual judicial cases, especially within the International Centre for Settlement of Investments Disputes. Unexpectedly, they have redounded in a progressive jurisprudence involving the ponderation of several factors, from which it seems possible to extract a trend to harmonize those regulatory developments until recently seen as inevitably colliding.
