| Abstract | 縱觀世界各國，在刑事審判前程式中，甚至在刑事訴訟程式正式開啟之前，已有短期拘束人身自由之強制處分存在。所謂短期拘束人身自由措施，系與相對較長期間拘束人身自由的審前羈押 相區別，在中國內地、澳門、臺灣稱謂各異，有拘傳、拘留、拘提、逮捕等。本文試圖在三地紛繁複雜的名詞下歸納出一個基於不同措施功能的短期拘束人身自由措施之體系，並基於該功能性平臺對三地刑事訴訟中的拘傳、拘留、拘提、逮捕等措施進行實質性分析，提出重新構建中國內地短期拘束人身自由之強制處分體系，並廢除逕行拘傳制度的建議。 |
