| Abstract | 澳門刑事特別程序的設置未能有效發揮程序分流的功能，本次澳門刑事訴訟法典修改草案大幅借鑒葡萄牙刑事訴訟法典的有關規定，以期解決目前刑事案件的積壓問題。但是，1998年葡萄牙刑事訴訟法典所確立的包括“簡捷訴訟程序”在內的特別訴訟程序已不能代表大陸法系國家的普遍做法和發展趨勢。因此，有必要審慎思考本次澳門刑事訴訟法修改的路徑，考慮引入目前大陸法系國家普遍適用的認罪協商程序。 |
