| Abstract | 不论是大陆法系还是英美法系，都将要约与承诺作为描述合同缔结过程的专门术语。通过历史梳理，本文展示了这一对术语并未直接在罗马法当中出现，而是在汲取罗马法、教会法等诸种养分之后，经波蒂埃等人的推动才形成了跨越法系的影响力。本文的历史考察意在说明，要约承诺虽然是唯一呈现在法典中的缔约流程，但缔约是不是只能通过要约承诺这一种方式，却值得推敲。这一思考对正在制定民法典的中国，更有意义。 |
