| Abstract | 翻译立法行为由来已久，始于秦汉律，最早见于张家山出土汉简《二年律令》的“译讯人诈伪”，两千多年来基本隶 属于诈伪律的“证不言情”律，只是译者的称谓和量刑有一定的变化。由于无法判定译者是故意误翻还是翻译能力不足，无 法确定翻译对错的标准，无法规定谁来判定翻译对错，所以没有形成规范翻译行为的完备的、成文的翻译法。当今的翻译立 法依然存在上述困境，建议从宏观上规范翻译行业企业和翻译人员的准入制度，从微观上确定翻译的行业标准，建立翻译争 议的仲裁机制，实现翻译立法。 |
