Abstract

拉美国家是“一带一路”倡议的积极支持者。中拉经贸关系素来以互利共赢为基础。然而中国在拉美的投资(特别是矿业投资)中,由“资源诅咒”所产生的环境、劳工权益等社会问题给投资回报带来极大不确定性因素。本文以“社会认同”理论基础上发展的“社会许可”理念为中心,从企业合规的角度出发,讨论企业的“社会许可”经营义务,并在分析国际投资条约晚近发展趋势的基础上,梳理中国与拉美国家签署的双边投资经贸条约,探讨以保持中拉经贸关系可持续发展为目的的绿色投资规范的构建.

Other Abstract

Latin American countries are active supporters of the “Belt and Road” initiative. China-Latin America economic and trade relations have always been based on mutual benefit and win-win results. However, in China’s investment in Latin America (especially mining investment), social issues such as the environment and labor rights generated by the “resource curse” developed on the basis of the “social identity” theory. From the perspective of corporate compliance, it discusses the business obligations of “social license” and analyzes the recent development trend of international investment treaties. It reviews the bilateral trade and investment treaties signed between China and Latin American countries, and discusses the construction of green investment norms aimed at maintaining the sustainable development of Sion-Latin American trade and investment relations.
