Abstract | This chapter evaluates the participation of the BRICS countries in the World Trade Organization’s Dispute Settlement Mechanism (WTO DSM) with the aim of evaluating the current and potential role of the BRICS alliance in maintaining and strengthening this multilateral trade governance platform. A detailed quantitative and qualitative analysis of the BRICS countries’ record in the WTO DSM demonstrates that, unlike many other emerging economies, the BRICS nations have largely managed to overcome the obstacles of access to the WTO DSM and have been using it actively to protect their national trade interests. While being primarily active as third parties, the BRICS countries have aligned their positions in the majority of cases in which they have ‘interacted’ with each other. The chapter explores possible directions for further coordination of the BRICS’ countries activities in the WTO DSM with the involvement of the private sector and other stakeholders. Such coordination could create much-needed synergies for the expedient settlement of trade disputes and clarification of the WTO trade rules. |
